Brownmark's motivation for bringing the lawsuit is deemed to be "questionable" since it waited two years to bring the lawsuit and was warned that South Park's use was fair. The judge sees this as evidence that the plaintiff was using "the threat of litigation against the defendants as a sort of 'sword of Damocles'-hanging by a thread over the heads of the defendants while Brownmark attempted to extract a licensing fee." In order to deter others from going this same route at the cost of free speech, the judge thinks its proper to award $31,525.23. Viacom had requested $46,775.23 but the judge takes pity because Brownmark is a "very small entity, without extensive assets."The judge also indicates he's willing to knock the fee down more if Brownmark submits documentation of its financial situation. The complex legislation is aimed at so-called rogue websites that operate overseas, preventing law enforcement from shutting them down directly. It calls for shutting off support to such sites, with the Justice Dept. able to obtain court orders to require that Internet service providers and search engines take "technically feasible and reasonable measures" to cut off access and links, and that payment processors and ad networks curb the flow of money to the infringing sites. The legislation calls on ISPs to block access to domain names via filtering, a process that critics claim will not only harm the architecture of the Internet but would be easily circumvented. But Castro found that claims that the legislation would "break the Internet" and lead to censorship were "unjustified." He wrote that such filtering is already in use today, such as when a user erroneously types in a domain name and is redirected to a search engine suggesting possible alternatives. And although there would be ways to circumvent the blockage of sites, "it is unlikely to be employed by a significant number of users," he wrote. He also challenged another claim, that the legislation will induce other countries to restrict free speech if the U.S. is filtering out sites, as irrelevant. He noted that regardless of whether the legislation passes, "Other countries will continue to be free to block access to websites if they so choose (and most will continue to choose to do so)." The legislation looked to be winning widespread support in Congress until Internet companies, public interest groups and other critics increased their effort to block its passage, with lawmakers such as Rep. Ron Paul (R-Texas) expressing opposition and House Minority Leader Nancy Pelosi expressing skepticism. A flurry of lobbying activity is under way in the lead-up to the expected Dec. 15 markup of the bill in the House Judiciary Committee, whose chairman, Lamar Smith (R-Texas), is sponsoring the legislation. Earlier this week, MoveOn sent emails to members calling on them to pressure Google, which is opposed to the legislation, to quit the U.S. Chamber of Commerce, which is lobbying for passage. Castro did find validity in some detractors' criticisms, including that the legislation is written so broadly as to potentially affect legitimate sites. He called for the legislation to be revised to make a clearer distinction between foreign and domestic sites and to clarify the definition of sites "dedicated to infringing activities." He also suggested that controversial provisions that allow for copyright holders to take their own actions against payment processors and ad networks that support rogue sites should be replaced by voluntary agreements between Internet firms and content owners. Pandora Stock Drops, TiVo Shares Rise After Strong Results

NY - Internet radio firm Pandora and TiVo Inc. both reported better-than-expected quarterly results late Tuesday, but their stocks went in different directions on Wednesday. While the company had posted a surprise profit for the third quarter, Pandora shares dropped as Wall Street seemed concerned about its financial outlook. Stifel, Nicolaus analyst Jordan Rohan summarized the results this way: "Solid report, but likely not enough to driver near-term upside." He said that guidance of $80 millionth- $84 million in fourth-quarter revenue "was below previous implied guidance...despite the strong third-quarter beat." As of 9:50am ET, the stock was down 10.6 percent at $10.60, close to its low of $9.33, which it had established in September. Meanwhile, TiVo's latest quarterly results had exceeded Wall Street expectations and seen the DVR firm return to overall subscriber growth for the first time in four years. The stock was up 5.9 percent at $10.13 as of 9:50am ET. It has traded between $7.06 and $12.65 over the past year. Janney Montgomery Scott analyst Tony Wible on Wednesday raised his fair value on the stock by 50 cents to $18.50. Lauding a "good quarter," he also argued that "core momentum and legal prospects improve risk/reward" for investors. TiVo has been in patent litigation with AT&T and others that observers say could lead to trial results or settlements that should benefit TiVo. Marc Buckland Sells Comedy, Drama Projects To NBC

EXCLUSIVE: Director-producer Marc Buckland has sold two projects to NBC, comedy RIP and drama State Of Mind. Both hail from Universal Television where Buckland is under a two-year development deal. He most recently directed the pilot for NBC’s new drama Grimm, which got off to a strong start last Friday. In his pilot writing debut, Buckland will pen and direct the single-camera comedy RIP, about a reluctant angel. A “Kindness Guru” who happens to be anasshole dies and inorder to get to heavenisforcedto return to earth and help people with the help of his simple minded brother. Buckland is executive producing with Nina Wass. Buckland’s directing duties on an NBC single-camera comedy pilot, that for the network’s series My Name Is Earl, earned him an Emmy Award. Drama State Of Mind, which will be written by Daniel Arkin (Kyle XY), centers on a police forensic psychologist who helps solve the most mysterious homicide cases by getting into the minds of the victims, all while starting to lose his own. Arkin and Buckland executive produce. The two previously worked together on NBC’s drama series Medical Investigation where Buckland directed an episode written by Arkin. Buckland is with ICM.

AFM 2011: Sony Picks Up Michael Winterbottom's 'Bailout' Starring Jack Black

Sony Pictures Worldwide Acquisitions has picked up Michael Winterbottom's upcoming comedy Bailout, starring Jack Black, for multiple territories, including North America, South America, Australia, South Africa and Scandinavia from Ealing Metro.our editor recommendsJack Black to Star in Michael Winterbottom Comedy (Cannes)dialogue with Michael Winterbottom The comedy is based on the novel The Financial Lives of the Poets by Jess Walter. Black stars as Matt Prior, a down-on-his luck chump who finds himself jobless, deep in debt and convinced his wife is having an affair. He decides to go to extreme measures to get his life back. Michael Besman (About Schmidt) and Melissa Parmenter (Trishna) are producing the Revolution Films/Ballyhoo/Electric Dynamite producion with shooting set to start in January 2012. Ealing said it will be announcing remaining cast members shortly. The ever-industrious Winterbottom is also in early prep on a film based on the sensational murder trial, and eventual release, of Amanda Marie Knox. "We're delighted to partner with Sony on this film," said Ealing Metro head Will Machin. "They share our enthusiasm for the project and our excitement at the pairing of Michael and Jack in this smart commercial comedy." Steven Tyler Suffers Fall; Concert Delayed

Steven Tyler Aerosmith front man and American Idol judge Steven Tyler suffered a spill in the shower that has delayed a concert in Paraguay, Reuters reports. Tyler, 63, was taken to Paraguay's La Costa medical center after suffering cuts to his face and the loss of two of his teeth after the fall. Check out the rest of today's news "Mr. Tyler had a small accident that prevents him from staging the concert tonight," a spokesman for the concert organizers told reporters. "He is fine, he's in his hotel, but he's not able to do the concert." Another organizer stated that Tyler had been suffering from dehydration and gastrointestinal problems. The concert has been rescheduled for Wednesday.

Matt's Guide to Thursday TV: Person of Interest, Vampire Diaries and More!

Jim Caviezel CBS' Person of Interest (9/8c) is one of the fall's few new dramas of interest, and it appears to be a keeper. Though not without some formula aspects - this is CBS, after all, so things tend to get wrapped up pretty neatly by the hour's end - the intriguing Interest sends its damaged heroes on their high-tech vigilante missions under a tantalizing cloak of paranoid secrecy. Each week, there's also the promise of heightened and stylized mayhem at the hands of the coolly lethal Reese (Jim Caviezel), who's so unflappably taciturn in his explosive takedowns of rooms full of bad guys he can make Jack Bauer look like a blabbermouth wimp.Reese's partner in crime-stopping, Michael Emerson as the mousy genius Finch, is equally reserved and mysterious, but just as determined to see justice done by targeting potential victims and/or perps, staying a step ahead of the perplexed authorities. There's an urgency to their rogue actions, and that's especially true with this week's episode, made available for preview, in which they come to the aid of a tough judge (David Costabile, most recently the ill-fated chemist Gale on Breaking Bad) who's being squeezed by villains (including Fringe Observer Michael Cerveris) who've kidnapped his son.When Reese steps in, the judge alternately sputters, "Who are you? What are you? Where are you getting your information?" (The last question involves "the Machine," which no one really understands, so best not to go there.) Reese follows his leads with Terminator-like bluntness, not exactly taking no prisoners - because a few end up trussed in a car trunk - but never flinching from hand-to-hand combat or a gun battle. It's all a bit over the top, but much twistier and less conventional than the standard whodunit. It's worth checking out as it settles in on one of the week's busiest nights.Want more Matt Roush? And who's the new student in Alaric's history class?The OWN Documentary Club takes on the media (including TV, movies, the Internet, publishing and advertising) for their discouraging and demeaning depiction of women, emphasizing images of beauty and conformity, in Miss Representation (9/8c), with cultural/political heavyweights including Condoleezza Rice, Katie Couric, Nancy Pelosi, Rachel Maddow and Gloria Steinem weighing in.Few of the above are likely to be champions of MTV's appallingly successful Jersey Shore (10/9c), which wraps its season-long excursion to Florence, Italy - an historic locale that may have weathered worse invasions, though it's hard to imagine - as the gang packs up to return to Seaside Heights, regardless of the governor's feelings about them. This will be followed by a premature reunion show at 11/10c, and an online Jersey Shore Hook-Up live stream (two words you really don't want to association with this crew) at midnight/11c, as they answer fan questions from Times Square.On CBS, the Engagement is back on. Rules of Engagement, that is, the longtime utility player that was supposed to have been banished to Saturdays this fall to burn off its sixth season for syndication purposes. But then the atrocious How to Be a Gentleman crashed and burned on Thursday, so Rules is back (8:31/7:31c) as a Big Bang companion piece, kicking off its new season with Russell trying to weasel out of his marriage to Liz (Bridesmaids' Wendi McLendon-Covey).Giving Skin-emax a run for its money, Showtime gets dirty after hours with the second-season premiere of Gigolos (11/10c), about the "unscripted" exploits of male escorts in Las Vegas. This is being paired, we kid you not, with Dave's Old Porn (11:30/10:30), a soft-core twist on Mystery Science Theater 3000. Comedian Dave Attell guides viewers through a retro stash of vintage VHS porn, which he watches and mocks alongside such outspoken celebrity friends as Chelsea Handler, Adam Carolla and Whitney Cummings. Look for actual porn stars to drop by to discuss their classic performances. Because it's doubtful they have a better offer.So what else is on? ... Guest-star alert: The hilarious Laurie Metcalf returns to CBS' The Big Bang Theory as Sheldon's mom. ... A.J. Langer, who we've loved since she was Angela's BFF Rayenne on My So-Called Life almost a generation ago, shows up on ABC's Private Practice (10/9c) as a woman from Cooper's past - because Charlotte apparently hasn't suffered enough. ... Coldplay guests on Comedy Central's The Colbert Report (11:30/10:30c) for the first time, performing the TV debut of a song from their new album "Mylo Xyloto." And finally, for reality fans, a twofer from CMT: Sweet Home Alabama (9/8c), which is basically a countrified Bachelor, builds its second season around last year's runner-up Tribble Reese, a former Clemson quarterback who gets to choose between city and country girls. This is followed by the sixth-season premiere of Dallas Cowboys Cheerleaders: Making the Team (10/9c), and I'm just sorry Carson Kressley won't get to reprise this week's rah-rah Dancing With the Stars routine on the show.
